DEFINITIONS<\/strong><\/p><ul><li>1.1. The expression \u201conline sales contract\u201d or \u201ccontract\u201d means the purchase and sale agreement relating to the Supplier&#8217;s tangible movable goods, stipulated between the Supplier and the Buyer within a remote sales system using electronic tools, organized by the Supplier.<p>1.2. The expression \u201cBuyer\u201d means the natural person, over 18 years of age, who makes the purchase, referred to in this contract, for purposes not related to any commercial, entrepreneurial, artisanal, or professional activity carried out.<\/p><p>1.3. 1.3. The expression \u201cSupplier\u201d means the subject identified above or the subject who sells the goods through the website indicated in the following article.<\/p><\/li><\/ul><p>Art. 2<\/p><ol start=\"2\"><li>2. GENERAL PROVISIONS<\/li><\/ol><p>2.1. 2.1. These general conditions of sale (hereinafter, \u201cGeneral Conditions\u201d) govern all sales of \u00e8ssenziale products (hereinafter, \u201cProducts\u201d or \u201cProduct\u201d) concluded remotely on the website www.essenziale.eu (hereinafter, the \u201cSite\u201d).<\/p><p>2.2. 2.2. The language used for the conclusion of sales contracts through this Site is Italian.<\/p><p>Art. 3<\/p><h4>3. INFORMATION RELATING TO PRODUCTS AND THEIR AVAILABILITY<\/h4><p>3.1. 3.1. Information relating to the Products, together with their price, is available on the Site.<\/p><p>3.2. 3.2. The Supplier reserves the right to limit, at any time, the quantity and\/or type of Products purchasable on the Site. The style, models, and colors of the Products described on the Site may be modified without notice. During the purchase procedure, if it is not possible to process the order due to the lack of availability of the ordered Product, the Buyer will be notified via an automatic message. The Supplier can in no case be held responsible towards the Buyer due to the lack of availability of a Product.   <\/p><p>Art. 4<\/p><h4>4. PRICES<\/h4><p>4.1. 4.1. All sales prices of the products are indicated at the web address www.essenziale.eu or another page available within the website, are expressed in Euro, and constitute an offer to the public pursuant to art. 1336 of the Italian Civil Code. <\/p><p>4.2. 4.2. The sales prices referred to in the previous point include VAT and any other taxes. Shipping costs and any ancillary charges, if present, although not included in the purchase price, are indicated and calculated in the purchase procedure before the Buyer submits the order and are contained in the order summary web page, as well as in the summary e-mail sent following the conclusion of the purchase procedure. <\/p><p>4.3. 4.3. Any promotional offers are specifically indicated and marked within the site with the wording \u201cpromotional offer,\u201d \u201cproduct in promotion,\u201d or equivalent denominations.<\/p><p>Essenziale may modify the sales prices of the Products at any time and without notice and without the need for justification or specification. Such modification will be signaled to the Buyer before sending any Order. <\/p><p>The prices of the Products do not include shipping costs. The costs and times relating to the different delivery methods can be consulted on the dedicated page. <\/p><p>Art. 5<\/p><h4>5. PRODUCT AVAILABILITY<\/h4><p>The offers presented by Essenziale are valid for as long as they are published on the Site and within the limits of available stocks. For Products not immediately available in Essenziale&#8217;s warehouses, the offers published on the Site will be valid subject to availability. Indications on the availability of the Products will be provided to the Customer at the time of sending an e-mail confirming receipt of the Order (hereinafter, the \u201cOrder Confirmation E-mail\u201d).  <\/p><p>Even following the sending of the Order Confirmation E-mail, cases of partial or total unavailability of the Products may occur. OBJECT OF THE CONTRACT<\/h4><\/div><p>6.1. 6.1. With this contract, the Supplier sells and the Buyer purchases remotely, via electronic tools, the tangible movable goods presented and offered for sale on the Site.<\/p><p>6.2. 6.1. With this contract, the Supplier sells and the Buyer purchases remotely, via electronic tools, the tangible movable goods presented and offered for sale on the Site www.essenziale.eu\/shop\/ <\/p><p>Art. 7<\/p><h4>7. METHOD OF STIPULATING THE CONTRACT<\/h4><p>7.1. 7.1. The contract between the Supplier and the Buyer is concluded exclusively through the Internet in remote electronic mode, by the Buyer&#8217;s access to the web address www.essenziale.eu where, following the procedures indicated therein, the Buyer formalizes the purchase of the goods referred to in point 2.1 of the previous article. The Buyer is aware that in order to access the websites www.essenziale.eu, it is necessary to have an Internet connection whose costs are borne by the Buyer according to the terms established by their connectivity provider. <\/p><p>Art. 8<\/p><h4>8. CONCLUSION AND EFFECTIVENESS OF THE CONTRACT<\/h4><p>8.1 The contract between the Supplier and the Buyer is concluded when the Buyer receives confirmation from the Supplier of the acceptance of the order proposal submitted through the procedure provided on the Site.<\/p><p>The acceptance (or refusal) by the Supplier of the order proposal will be transmitted to the Buyer at the e-mail address indicated by the Buyer in the order proposal (\u201cOrder Confirmation\u201d).<\/p><p>8.2 The Supplier may refuse an order proposal (in this hypothesis no amount will be due from the Buyer to the Supplier, except, possibly, for the sums indicated in the following article 6) in the following cases:<\/p><p>(I) in case of lack of availability of the Products (without prejudice to the provisions of articles 3.2 and 5); or<\/p><p>(II) in the event that the payment made by the Customer is not successful (for example, in case of failure to charge the purchase price to the Buyer&#8217;s credit card or, if the payment is made by bank transfer, in case of failure to confirm receipt of the transfer within 10 (ten) working days from the date of the order proposal); or<\/p><p>(III) in the event that there is a report, or suspicion, of fraudulent or illegal activities, including the suspicion that purchases are being made for commercial purposes;<\/p><p>(IV) in case of non-fulfillment by the Buyer of their obligations arising from a previous contract concluded with the Supplier.<\/p><p>8.3 In case of lack of availability of one or more ordered Products, the Customer will be notified via e-mail. In such an eventuality, the order proposal is cancelled, or accepted limited to the available Products. In case of partial acceptance, the Buyer is required to pay only the price relating to the available Products (if the payment is made by credit card, the Customer will be charged only the amount corresponding to the available Products).  <\/p><p>8.4 In accordance with the provisions of article 51, paragraph 7, of the Consumer Code, as defined below, the Order Confirmation will contain a summary of the essential characteristics of the purchased Products, the detailed indication of the price and payment methods, information relating to delivery costs, the conditions and methods of exercising the right of withdrawal, the indication of an address to which complaints can be submitted, and information on after-sales assistance services and existing commercial guarantees. The e-mail communication sent by the Supplier confirming the shipment of the Products, in accordance with the provisions of the following article 8.1 (\u201cShipment Confirmation\u201d). <\/p><p>8.5. 8.5. The risk of loss or damage to the Products is transferred to the Buyer at the moment in which the latter (or a third party designated by the Customer and different from the carrier) takes physical possession of the Product.<\/p><p>Art. 9<\/p><h4>9. PAYMENT METHODS<\/h4><p>9.1. 9.1. The Buyer may make the payment of the fee relating to the Products contained in the order proposal and the shipping costs by PayPal, Credit Card, Bank Transfer, and Cash on Delivery.<\/p><p>9.2. 9.2. The Supplier accepts payments made through the following payment methods:<\/p><p>Visa, Mastercard, Maestro, Masterpass, Apple Pay, Google Pay, and PayPal.<\/p><p>9.3. 9.3. The charging of transactions to the Buyer&#8217;s credit card will be carried out only after:<\/p><p>(I) the credit card data have been verified;<\/p><p>(II) authorization to charge has been received from the company that issued the credit card used by the Buyer.<\/p><p>9.4. 9.4. In the event that, for any reason, within a period of 10 (ten) working days from the date of the order, it is not possible to charge the amounts due from the Buyer to the credit card, it will not be possible to execute the contract and the order is considered cancelled.<\/p><p>Art. 10<\/p><h4>10. TRANSPORT AND DELIVERY<\/h4><p>10.1. 10.1. The Products will be delivered to the address indicated by the Buyer in the order proposal. Upon delivery, the signature of the Buyer (or their delegate) is required. Deliveries are not made to P.O. boxes.  <\/p><p>10.2. 10.2. For each order, the Supplier will issue a specific purchase receipt which will be sent to the Buyer via e-mail or by mail in compliance with current legislation. The purchase receipt is issued based on the information provided by the Buyer at the time of the order. Variations to the purchase receipt after its issuance are not allowed. The Invoice must be requested before the purchase is concluded. Invoices cannot be requested after the order has been closed.    <\/p><p>10.3. 10.3. Delivery costs remain the responsibility of the Buyer and are highlighted separately in the order form.<\/p><p>10.4. 10.4. The purchased products will be delivered via a courier selected by the Supplier (hereinafter \u201cCourier\u201d) on working days (thus excluding Saturdays, Sundays, and local or national holidays) from the day following the order up to a maximum of 30 (thirty) days from the confirmation of the same, as provided by current legislation. In the event that the Supplier is unable, for any reason, to make the shipment within said term, they will give prompt notice to the Buyer via e-mail sent to the address provided by the latter during the purchase procedure. <\/p><p>10.5. 10.5. The Buyer (or their delegate) is required to check, at the time of delivery of the Products by the Courier:<\/p><p>(I) that the number of packages being delivered corresponds to that indicated in the delivery note; and<\/p><p>(II) that the packaging and its seals are intact, not damaged, not wet, or altered in any way.<\/p><p>Any damage to the packaging and\/or the Product or the mismatch in the number of packages or indications must be immediately contested in writing on the Courier&#8217;s delivery note. Once the Courier&#8217;s document has been signed without the Buyer having raised any objections, the Buyer will not be able to oppose any dispute regarding the external characteristics of the delivered package. <\/p><p>Art. 11<\/p><h4>11. CONFIRMATION OF SHIPMENT AND DELIVERY<\/h4><p>11.1. 11.1. The Supplier will send the Buyer a Shipment Confirmation e-mail following the shipment of the Products.<\/p><ol start=\"12\"><li>12. PACKAGING<\/li><\/ol><p>12.1. 12.1. The Products purchased on the Site are delivered using the standard packaging used by the Supplier.<\/p><p><strong> <\/strong>Art. 13<\/p><h4>13. RIGHT OF WITHDRAWAL<\/h4><p>13.1 In the event that the Buyer is not satisfied with the products they have purchased or if they have changed their mind, they may return them and obtain a refund after receiving them. The right of return must be exercised at the latest within 14 days from the day on which delivery took place. <\/p><p>The Buyer can return the purchased products, or part of them, using the packaging in which they were delivered.<\/p><p>The returned Products must be accompanied by a document containing a text in which the following information must be communicated:<\/p><p>\u2013 Customer\u2019s Name and Surname<\/p><p>\u2013 Customer\u2019s Address<\/p><p>\u2013 Order number and date<\/p><p>\u2013 Item description, quantity, reason for return, and relative amount paid<\/p><p>Ship the return to:<\/p><p><strong>Claudio Gori &#8211; Strada del Cantiere, 2 &#8211; 50028 \u2013 Barberino-Tavarnelle (FI)<\/strong><\/p><p>In the event that the goods arrived damaged or if products were delivered that do not correspond to those ordered, the Supplier will bear the shipping costs. We recommend choosing a secure shipping method such as registered mail. <\/p><p>Please be informed that the right of withdrawal lapses in the case of intact products that are returned damaged (for reasons other than transport), incomplete or missing parts, with damaged primary or secondary packaging, or if the goods are returned after the maximum return period.<\/p><p>PLEASE NOTE: opened or used packages, even partially, will not be compensated in any way and without any exception.<\/p><p>The shipping costs relating to the return of the goods are borne by the customer as dictated by law.<\/p><p>Once the withdrawal request has been received and accepted, Essenziale will refund the entire amount paid by the customer within 30 days.<\/p><p><strong>13.2 Possibility of order cancellation\/modification<\/strong><\/p><p>Once the order is in the confirmed state, it is not possible for us to cancel or modify it, as the products are already in the preparation phase in order to guarantee the shortest possible processing time.<\/p><p>To cancel your order, please proceed with your <strong>right of withdrawal<\/strong> once the order has been received.<\/p><p>Art. 14<\/p><h4>14. PRODUCT REPLACEMENT<\/h4><p>14.1. Fermi restando i diritti dell\u2019Acquirente previsti dagli articoli 13 e 15 delle presenti Condizioni Generali, il Fornitore non riconosce in ogni caso all\u2019Acquirente la possibilit\u00e0 di sostituire i Prodotti acquistati sul Sito con altri prodotti.<\/p><ol start=\"15\"><li>DIFETTI DI CONFORMIT\u00c0<\/li><\/ol><p>15.1. The sale of the Products is subject to the legal guarantees provided by articles 129, 130, and 132 of the Consumer Code, as defined below. Pursuant to these regulatory provisions, the Buyer has the right to obtain the restoration of the conformity of the good by repair or replacement (the Buyer may choose whether to obtain the repair or replacement of the Product under the conditions provided by law), without any expense on their part, or, in the event that one of these remedies is not successful (as provided for in article 130, paragraph 7, of the Consumer Code), they may obtain an appropriate reduction in the price of the Products or the termination of the contract. The Buyer loses these rights if they do not report the lack of conformity to the Supplier within the term of 2 (two) months from the date on which they discovered such lack of conformity. The action aimed at asserting a lack of conformity not maliciously hidden by the Buyer is prescribed, in any case, in the term of 26 (twenty-six) months from the delivery of the Product.   <\/p><p>13.3. In the event that the Buyer requests, within the terms of this article 13, the repair or replacement of the Product due to a lack of conformity of the Product, the delivery costs relating to the return to the Supplier of the Product to be repaired or replaced, as well as all costs relating to the delivery to the Buyer of the repaired or replaced Product, remain the responsibility of the Supplier.<\/p><p>Art. 15<\/p><h4>15. GUARANTEE OF AUTHENTICITY AND INTELLECTUAL PROPERTY RIGHTS<\/h4><p>15.1. 15.1. The Supplier guarantees the authenticity of all Products purchased on the Site. PROTECTION OF CONFIDENTIALITY AND PROCESSING OF THE BUYER&#8217;S DATA<\/h4><p>16.1 The Supplier protects the privacy of its customers and guarantees the compliance of personal data processing with the provisions of the privacy legislation referred to in Regulation (EU) 2016\/679 and the applicable legislation on the protection of personal data.<\/p><p>16.2 The personal, identifying, and fiscal data acquired by the Supplier, the data controller, are collected and processed in the forms and according to the methods provided by the Site&#8217;s Privacy Policy.<\/p><p>Art. 17<\/p><h4>17. APPLICABLE LAW AND COMPETENT JURISDICTION<\/h4><p>17.1. 17.1.
